Chapter 23 - Zoning Code Sections - 23.06 Enforcement and 23.07 Fees 23.06 ENFORCEMENT: VIOLATIONS AND PENALTIES 1. It shall be the duty of the Zoning Administrator; with the aid of the Police Department and City Attorney to enforce the provisions of this ordinance. 2. Any building or structure hereafter erected, moved, or structurally altered or any use hereafter established in violation of any of the provisions of this ordinance shall be deemed an unlawful building, structure or use. The Zoning Administrator shall promptly report all such violations to the City Attorney, who shall bring action to enjoin the erection, moving, or structural alteration of such building, or the establishment of such use or to cause such building, structure, or use to be vacated or removed. 3. Every structure, building, fill or development placed or maintained within any flood plain in violation of this ordinance is a public nuisance and the creation thereof shall be enjoined and maintenance thereof shall be abated by action at suit of the City, the State, or any citizen thereof. 4. Any person, firm or corporation who violates, disobeys, neglects, or omits, any provision of this ordinance, or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance may also be required, upon conviction, to forfeit not less than $35 nor more than $500 for each offense, together with the cost of prosecution, and in lieu of payment of the forfeiture and costs, imprisonment in the County Jail of Portage County not to exceed 30 days. Each day that a violation exists shall constitute a separate offense. Every violation of this chapter is a public nuisance and may be enjoined and the maintenance thereof may be abated by action at suit of the City of Stevens Point, the State, or any citizen thereof. In addition to the penalty, the owner shall be ordered to cease or correct the violation in a reasonable period of time as established by the City. 23.07 Fees: Amendments and Conditional Use Applications. The Common Council proposes to establish the following fees: Zoning Amendments, $90.00 and Conditional Use Requests, $90.00. No application shall be accepted unless accompanied by the established fee. The applicant shall post a sign supplied by the city notifying the public of a proposed change. The sign shall be posted from the time of application to the final action by the Common Council. The posting of the sign is in addition to public notices required by law.
