2. Introduction of Shirley Gibb and Gibbtown.

Mrs. Gibb, along with the students, were pleased to have the opportunity to be involved in the Common Council meeting and its procedures. This evening is the thirteenth annual visit to the Common Council meeting by Mrs. Gibb and the students of the NOVA program.

3. Salute to the flag and prayer.

Salute to the flag was led by Kara Biasca, Jane Christenson and Ryan DeMarco and the prayer was led by Garrick Rohm and Trevor Thompson from Mrs. Gibb's class.

4. Approval of minutes of the Regular Common Council meeting of August 16, 1999.

Ald. Rackow moved, Ald. Walther seconded, to approve the regular council minutes of August 16, 1999.

Roll Call: Ayes all.
Nays none. Motion carried.

5. *Persons who wish to address the mayor and council on specific agenda items.

None.

6. Presentation of plaque to Mary Thurmaier in honor of her late husband, Roland Thurmaier.

Mayor Wescott, Alderman Pazdernik and Transit Manager Lemke presented Mary Thurmaier with a plaque and proclamation in honor of her late husband, Roland Thurmaier.

Mary Thurmaier is honored to receive the plaque and proclamation in honor of her late husband, Roland and would like to thank everyone involved. Roland deeply cared about the environment, people and transportation. Mr. Thurmaier fought long and hard for mass transportation in Stevens Point. Keep the buses rolling, keep Roland's spirit alive.

7. Plan Commission meeting of September 7, 1999.

Ald. Rackow moved, Ald. Sevenich seconded, for approval of the Plan Commission minutes of September 7, 1999.

Ald. Nealis abstained from items #8 and #9 of the Plan Commission minutes of September 7, 1999.

Roll Call: Ayes: Ald. Sevenich, Walther, Pazdernik, Perlak, Barr, Rackow, Nealis, Phillips, Niedbalski.
Nays: Ald. Kedrowski.

8. Resolution - Final Plat of Parkdale Subdivision.

Ald. Niedbalski moved, Ald. Pazdernik seconded, for adoption of the resolution.

Roll Call: Ayes: Ald. Niedbalski, Phillips, Rackow, Barr, Kedrowski, Perlak, Pazdernik, Walther, Sevenich.
Nays: None.
Ald. Nealis abstained. Motion carried.

9. Resolution - Land Dedication - Parkdale Development.

Ald. Pazdernik moved, Ald. Walther seconded, for adoption of the resolution.

Roll Call: Ayes: Ald. Sevenich, Walther, Pazdernik, Perlak, Kedrowski, Barr, Rackow, Phillips, Niedbalski.
Nays: None.
Ald. Nealis abstained. Motion carried.

10. Public hearing - request for a conditional use - zero lot line - 2133 Oak Street, was declared open by the Mayor.

As no one wished to speak, the Mayor declared the public hearing closed.

11. Resolution on the above.

Ald. Rackow moved, Ald. Barr seconded, for adoption of the resolution.

Roll Call: Ayes: Ald. Niedbalski, Phillips, Nealis, Rackow, Barr, Kedrowski, Perlak, Pazdernik, Walther, Sevenich.
Nays: None. Motion carried.

12. Public hearing - request for a conditional use - reduced garage setback - 724 Prentice Street, was declared open by the Mayor.

As no one wished to speak, the Mayor declared the public hearing closed.

13. Resolution on the above.

Ald. Walther moved, Ald. Sevenich seconded, for adoption of the resolution.

Roll Call: Ayes: Ald. Sevenich, Walther, Pazdernik, Perlak, Kedrowski, Barr, Rackow, Nealis, Phillips, Niedbalski.
Nays: None. Motion carried.

14. Public hearing - request for a conditional use - reduced garage setback - 1117 Wisconsin Street, was declared open by the Mayor.

Roger Bugarske, property owner, is requesting the wording for the reduced garage setback at 1117 Wisconsin Street be changed from two-feet from the principal building to the garage being attached to the principal building.

Director John Gardner explained the setback requirements and Mr. Bugarske's request would require changing the current ordinance.

15. Resolution on the above.

Ald. Niedbalski moved, Ald. Perlak seconded, to reject the resolution as presented and direct this issue back to staff for further study.

Roll Call: Ayes: Ald. Sevenich, Walther, Pazdernik, Perlak, Kedrowski, Barr, Rackow, Nealis, Phillips, Niedbalski.
Nays: None. Motion carried.

16. Public hearing - amending street setback requirements - corner lots "R-2" and "R-3" zoning districts, was declared open by the Mayor.

As no one wished to speak, the Mayor declared the public hearing closed.

17. Ordinance on the above.

Ald. Pazdernik moved, Ald. Walther seconded, for adoption of the ordinance.

Roll Call: Ayes: Ald. Niedbalski, Phillips, Nealis, Rackow, Barr, Kedrowski, Perlak, Pazdernik, Walther, Sevenich.
Nays: None. Motion carried.

18. Public hearing - request for a conditional use and amending existing conditional use - 5373 Highway 10 East, was declared open by the Mayor.

Steve Katner, adjacent property owner, agrees with the fixed fencing and also expressed the importance of maintaining the trees as a noise buffer.

Mark Sommers, representing Tom Markovich, stated a solid fence would not allow for access to the green area. Some type of door in the fence would be needed in order to access the green area.

19. Resolution on the above.

Ald. Rackow moved, Ald. Barr seconded, for adoption of the resolution with amendment that the spaces between the new buildings and the existing buildings along the east side of the property are to be fenced with fixed fencing with material similar to the existing fence with a small door not to exceed five feet in width.

Ald. Nealis said a three-foot door would not be wide enough for some types of equipment to pass through.

Mark Sommers stated a door with an opening of four to five feet would work well.

Ald. Rackow amended the motion to allow for the access with a small utility door of not more than five feet in width.

20. Public hearing - request for a conditional use - 42-unit apartment proposal - Parkdale Development - Sandpiper Drive, was declared open by the Mayor.

As no one wished to speak, the Mayor declared the public hearing closed.

Ald. Walther moved, Ald. Pazdernik seconded, for adoption of the resolution.

22. Public Protection Committee meeting of September 13, 1999.

Ald. Niedbalski moved, Ald. Perlak seconded, for approval of the Public Protection Committee minutes of September 13, 1999.

Roll Call: Ayes all.
Nays none. Motion carried.

23. Ordinance - Bond Schedule - Truancy.

Ald. Rackow moved, Ald. Pazdernik seconded, for adoption of the ordinance.

Roll Call: Ayes: Ald. Sevenich, Walther, Pazdernik, Perlak, Kedrowski, Barr, Rackow, Nealis, Phillips, Niedbalski.
Nays: None. Motion carried.

24. Board of Public Works meeting of September 13, 1999.

Ald. Perlak moved, Ald. Niedbalski seconded, for approval of the Board of Public Works minutes of September 13, 1999.

Roll Call: Ayes: Ald. Niedbalski, Phillips, Nealis, Rackow, Barr, Kedrowski, Perlak, Pazdernik, Walther, Sevenich.
Nays: None. Motion carried.

25. Ordinance - traffic.
99-08-A No Parking Krembs Avenue

Ald. Nealis moved, Ald. Pazdernik seconded, for adoption of the ordinance.

Roll Call: Ayes: Ald. Niedbalski, Phillips, Nealis, Rackow, Barr, Kedrowski, Perlak, Pazdernik, Walther, Sevenich.
Nays: None. Motion carried.

26. Finance Committee meeting of September 13, 1999.

Ald. Barr moved, Ald. Pazdernik seconded, for approval of the Finance Committee minutes of September 13, 1999.

Comptroller/Treasurer Schlice stated the motion for item #9 of the Finance Committee minutes of September 13, 1999, should also include; Ayes: All, Nays: None, Motion carried.

Roll Call: Ayes: Ald. Sevenich, Walther, Pazdernik, Perlak, Kedrowski, Barr, Rackow, Nealis, Phillips, Niedbalski.
Nays: None. Motion carried.

27. Ordinance - compensation for Board of Review members.

Ald. Pazdernik moved, Ald. Nealis seconded, for adoption of the ordinance.

Roll Call: Ayes: Ald. Sevenich, Walther, Pazdernik, Perlak, Kedrowski, Barr, Rackow, Nealis, Phillips, Niedbalski.
Nays: None. Motion carried.

28. Personnel Committee meeting of September 13, 1999.

Ald. Rackow moved, Ald. Walther seconded, for approval of the Personnel Committee minutes of September 13, 1999, with item #5 (tentative agreement with the firefighters) pulled to vote on this item separately and item #2 pulled for further discussion.

Roll Call: Ayes all.
Nays none. Motion carried.

Ald. Rackow moved, Ald. Perlak seconded, to ratify the 1999-2000 labor agreement with the firefighters.

Roll Call: Ayes: Ald. Niedbalski, Phillips, Nealis, Rackow, Barr, Kedrowski, Perlak, Pazdernik, Walther, Sevenich.
Nays: None. Motion carried.

Ald. Pazdernik would like clarification on the salary increase for the Comptroller/Treasurer. On January 1, 2000, the salary for the Comptroller/Treasurer will change to $42,093, will the additional $5,000 increase the salary to $47,093?

Mayor Wescott said according to the ordinance, the Comptroller/Treasurer's salary will increase to $45,867 as of January 1, 2000.

Ald. Perlak moved, Ald. Walther seconded, to increase the Comptroller/Treasurer's salary by $5,000, effective January 1, 2000.

Roll Call: Ayes all.
Nays none. Motion carried.

Ald. Rackow moved, Ald. Perlak seconded, for adoption of the ordinance.

30. Board of Park Commissioners meeting of September 1, 1999.

Ald. Nealis moved, Ald. Niedbalski seconded, for approval of the Board of Park Commissioners minutes of September 1, 1999.

Nays: None. Motion carried.

31. Board of Water and Sewage Commissioners meeting of September 13, 1999.

Ald. Niedbalski moved, Ald. Phillips seconded, for approval of the Board of Water and Sewage Commissioners minutes of September 13, 1999.

Roll Call: Ayes all.

32. Telecommunications Commission meeting of September 8, 1999.

Ald. Rackow moved, Ald. Walther seconded, for approval of the Telecommunications Commission minutes of September 8, 1999.

Ald. Barr moved, Ald. Sevenich seconded, for confirmation of the appointments.

35. Persons who wish to address the mayor and council on non-agenda items.

Parks and Recreation Director Tom Schrader announced the City of Stevens Point will host a professional ice show on October 25, 1999, at 7:00 P.M.
