1. License list.
Alderperson Phillips moved, Alderperson Walther seconded, to approve the new operator, temporary special Class
“B”/“Class B” retailer’s, manager’s, taxicab driver’s and change of agent licenses.
Ayes, all, nays, none. Motion carried.
Recommended rejection of operator’s license.
Chairman Niedbalski read the letters received from Jeffrey Kitzerow, the appellant and Michael Plaza, Elks Lodge
Manager. Mr. Kitzerow is unable to attend the meeting tonight due to his work schedule. Copies of these letters
are attached.
Police Captain Dowling stated the reason for the rejection is Mr. Kitzerow’s failure to list the two OWI convictions
on his application.
Ald. Sevenich questioned whether Mr. Kitzerow would be responsible enough to be a bartender when he cannot even
fill out the application accurately?
Alderperson Sevenich moved, Alderperson Nealis seconded, to deny the license for Jeffrey Kitzerow.
City Attorney Molepske noted that if Mr. Kitzerow is in charge of the bar and does not have a bartender’s license,
there might be a problem. The Police Department can investigate and if Mr. Kitzerow is selling alcohol without
a license and there is no licensed bartender in the area, he and the establishment can be cited.
Ald. Phillips said bartending is Mr. Kitzerow’s livelihood. The establishment has several licensed bartenders.
The OWI conviction is more of a personal nature than business. The alderperson said Mr. Kitzerow’s failure to list
the convictions could be an oversight on Mr. Kitzerow’s part.
Ald. Nealis feels the applicant’s failure to list the convictions on the application is grounds for denial. The
alderperson suggested having Mr. Kitzerow show up at the Council meeting on Monday, August 16, 1999, at 7:00 P.M.
Chairman Niedbalski stated the Police Department looks at this situation as a very serious one. The Public Protection
Committee has in the past denied license due to the applicant’s failure to list convictions on the application.
Ayes: Chairman Niedbalski, Alderpersons Sevenich, Walther, Nealis.
Nays: Alderperson Phillips. Motion carried.
2. Request to close Crosby Avenue - July
21 & 22, 2000 - Tater Town Nationals Rod and Custom Car Show.
John Tomaszewski, representing the Tater Town Nationals Rod and Custom Car Show was present. The request is to
be able to close down Crosby Avenue on July 21 & 22, 2000, similar to what is being done for Riverfront Rendezvous.
The difference on this request and that of the Riverfront Rendezvous is the car show organizers would like to have
Crosby Avenue closed down not only during the day but the entire evening to accommodate vendors’ parking. The vendors’
trailers are large and heavy and could possibly damage the grass at the park.
Police Captain Dowling said the Police Department recommends approval of the request.
Ald. Phillips asked if Pfiffner Pioneer Park is getting too small for the car show? Mr. Tomaszewski asked for the
alderperson’s suggestion as to other places where they could take this show. Ald. Phillips suggested having it
at the airport or at SPASH. Mr. Tomaszewski said the grounds at the airport do not compare with that of Pfiffner
Pioneer Park and he was informed by some airport officials about the restrictions on having an event like this
held at the airport. The
car show organizers would like to have this event closer to the downtown area.
Ald. Kedrowski said this event will bring people to the downtown businesses. Chairman Niedbalski stated Pfiffner
Pioneer Park is one of the best facilities in the area and is a good selling point.
Ald. Walther moved, Ald. Nealis seconded, to approve the request to close Crosby Avenue on July 21 & 22, 2000,
for the Tater Town Nationals Rod & Custom Car Show.
Ayes: Chairman Niedbalski, Alderpersons Sevenich, Walther, Nealis.
Nays: Alderperson Phillips. Motion carried.
3. Adoption of ordinance prohibiting truancy.
City Attorney Molepske said a meeting was held last week between himself, representatives from the school district,
social services, and the Police Chief. The County has an ordinance and technically the City can use it to make
the arrest. It gets to be a nuisance when both the County and the City have to coordinate the staff for the hearing.
The City under Chapter 119 of the Wis. Stats. has the authority to adopt an ordinance. The penalty on this ordinance,
depending on what it is for, is loss of license, supervision, fines, and other dispositions. City Attorney Molepske
talked to Police Chief Carpenter and explained that the penalties are provided by the statutes. The City Attorney
is asking the Public Protection Committee to pass the ordinance and recommends adoption of the same by the Common
Council.
Ald. Sevenich moved, Ald. Walther seconded, to approve the ordinance prohibiting truancy.
Ayes, all, nays, none. Motion carried.
4. Inspection Report.
Ald. Niedbalski moved, Ald. Nealis seconded, to accept the Inspection Report and place it on file.
Ayes, all, nays, none. Motion carried.
