SPECIAL PUBLIC PROTECTION COMMITTEE MEETING
Friday, April 9, 1999 - 5:00 P.M.
City Water Department - 300 Bliss Avenue

1. Transfer of vacant liquor license to Holiday Inn.

Chairman Niedbalski advised the committee that this item was taken off the agenda.

2. Ordinance creating provisional retail license.

The City Attorney was called upon to explain the reason for creating the ordinance on provisional retail licenses. City Attorney Molepske explained that the provisional retail license ordinance is an attempt to grant liquor licenses prior to the Public Protection committee's approving the liquor license. This license is good for sixty days with a fee of $15.00 and is to be issued by the Clerk. The statutes provide that the provisional retail license shall be issued only to a person who has applied for a Class "A", Class "B", "Class A", "Class B" or "Class C" license and authorizes only the activities that the type of retail license applied for authorizes.

There was a discussion with the counsel for Holiday Inn as to whether we need to create an ordinance to give them this provisional retail license. The City Attorney is requesting that the Common Council adopt the ordinance and that the Clerk issue the license to the Holiday Inn so they can get on with their business.

The purpose of this meeting is to insure that the Holiday Inn has a liquor license at the present time. The issuance of this license will not be considered in excess of the quota since the Holiday Inn is a hotel with 150 rooms and has a 300-banquet seating which is a special exception to the liquor law. A liquor license can be granted to this type of facilities even though our quota is filled at the present time.

The Holiday Inn has a physical license (maybe a copy) posted on the wall at the present time. The City granted the license to Stevens Point Wisconsin Beverage Corporation.. This is a delinquent corporation at the present time that might still be in existence. The corporation has not filed any reports. Letters mailed to the principals of this corporation came back. The Police Department tried to locate the principals of this corporation but could not find them.

Calling an emergency Common Council meeting for a similar situation has been done before. It was done for Pacelli Panacea, St. Joseph's Church Picnic, and most recently, it was done for St. Peter's Church's Italian Night.

Ald. Rackow moved, Ald. Kedrowski seconded, to recommend the creation of the ordinance on provisional retail licenses.

Ayes, all; nays, none. Motion carried.
