PUBLIC PROTECTION COMMITTEE
Monday, April 9, 2001 - 6:00 P. M.
City Water Department - 300 Bliss Avenue


Present: Chairman Phillips, Alderpersons Sevenich, Walther, Seiser, Sowieja

Mayor Wescott announced the unexpected death of former Mayor Scott Schultz who died on Sunday night, May 13, 2001. The mayor asked for a moment of silence for Mr. Schultz and his family.

1. License list.

Ald. Seiser moved, Ald. Sowieja seconded, for approval of the new operator’s/bartender’s (provisional) license, renewal operator’s/bartender’s license, and the supplemental operator’s/bartender’s (provisional) license list handed out tonight, except the recommended rejection of operator applications.

Ayes, all; nays, none. Motion carried.

Recommended Rejection

Cara L McManus - did not appear.

Ald. Walther moved, Ald. Sevenich seconded, to deny the application for operator’s/bartender’s license for Cara L. McManus.

Ald. Seiser noted that the violations were committed almost five years ago. The alderperson would like to know when Ms. McManus will be eligible to apply again.

Police Captain Daubert said Ms. McManus’ violations are non-compliance with court ordered issues. These violations have a different impact than the time period. The captain said Ms. McManus can come and prove that she is in compliance, which she has not done yet.

Ayes, all; nays, none. Motion carried.

Andrew W. Fietzer - was not present.

Ald. Sevenich moved, Ald. Seiser seconded, to deny the operator’s/bartender license application for Andrew W. Fietzer.

Ayes, all; nays, none. Motion carried.

Due to an incomplete license application, Clerk Zdroik asked that the transfer of license from the Final Score to Deborah Jean Billings be pulled from the agenda.

Ald. Sowieja moved, Ald. Seiser seconded, to approve the Manager’s license, Change in Officers of a Corporation, Transfer of licenses, Temporary Class "B"/"Class B" Retailers license, and Change of Agents, with no action taken on the transfer of license from the Final Score to Deborah Jean Billings due to an incomplete application.

Ald. Seiser asked about the reason for the Change in Officers of a Corporation.

Clerk Zdroik explained that the company’s name stayed the same but the officers of the corporation changed due to the properties changing ownership.

On the Stevens Point Area Catholic Schools request for a Temporary Class "B"/"Class B" Retailer’s license for Pacelli Panacea, Ald. Sevenich asked that the event organizers maintain a time limit of 11:00 P.M. for the playing of amplified music.

Captain Daubert stated the Police Department will help in the enforcement of the 11:00 P.M. time limit.

2. 2001-2002 Renewal list - beer and liquor.

Ald. Sevenich moved, Ald. Seiser seconded, for approval of the 2001-2002 Renewal list - beer and liquor, except for the Iguana Club due to unpaid 2000 Personal Property tax.

Ayes, all; nays, none. Motion carried.

3. Request for temporary parking on Crosby Avenue for Saturday, July 28 and Sunday, July 29, 2001 - 6th Annual CenterPoint MarketPlace 3 on 3 Basketball Tournament.

Captain Daubert said due to a public safety concern, the Police Department is asking not to grant the request.

Ald. Sevenich advised the tournament directors to make arrangements with the bank or elsewhere for additional parking.

3 on 3 Basketball Tournament Director Brian Decorah said they used the bank in the past and there are some issues with the bank. The tournament is growing every year and they anticipate this year to be the biggest year for team participation. He feels being able to park on Crosby Avenue is convenient and safe. He also notes there are a number of attendees that are not familiar with the areas in the City where they could park.

Captain Daubert said she is not aware of the number of parking spaces that could be made available on Crosby Avenue if they were allowed to park on both sides of the street. Parking is not allowed on Crosby Avenue during the Riverfront Rendezvous event, only drop-off for the vendors, the captain said. She feels there is ample parking around the area for the tournament.

Chairman Phillips understands the Police Department’s concern about people going in between parked cars.

Parks Director Schrader stated there is parking on the east side of Crosby Avenue but not on the west side. Parking on both sides of Crosby avenue is asking for trouble, the director said.

Other parking sites around the area were suggested including parking on the east side of the Pfiffner Building. Director Schrader said he will check on the availability of parking on that site.

Ald. Seiser moved, Ald. Walther seconded, to deny the request for temporary parking on Crosby Avenue for Saturday, July 28 and Sunday, July 29, 2001, for the 6th Annual CenterPoint MarketPlace 3 on 3 Basketball Tournament.

Ayes, all; nays, none. Motion carried.

4. Crosby Avenue closing - no parking zones - Friday, June 29 through Sunday, July 1, 2001 - Riverfront Rendezvous.

Ald. Seiser moved, Ald. Sevenich seconded, for approval of the Crosby Avenue closing and no parking zones for Riverfront Rendezvous, on Friday, June 29 through Sunday, July 1, 2001.

Ayes, all; nays, none. Motion carried.

5. Crazy Days Celebration - Tuesday, July 10 and Wednesday, July 11, 2001.

Captain Daubert stated there were no problems in the past and the Police Department has no objection to the request.

Ald. Sevenich moved, Ald. Sowieja seconded, to approve the closure of Main Street from Strongs Avenue to Water Street to vehicular traffic on Tuesday, July 10 and Wednesday, July 11, 2001, due to the Crazy Days Celebration.

Ayes, all; nays, none. Motion carried.

6. Request to extend licensed premises:

A. Joe Mama’s Catering, 1324 Second Street - Wednesday, July 11, 2001, from 5:00 P.M. to 9:00 P.M., final day of Crazy Days Sale/Downtown Street Festival.

Captain Daubert stated the Police Department has no problem or objection to the request.

Ald. Seiser moved, Ald. Sevenich seconded, for approval of the request to extend the licensed premises to Joe Mama’s Catering, 1324 Second Street, for the final day of the Crazy Days Sale/Downtown Street Festival, on Wednesday, July 11, 2001.

Ald. Sevenich informed the Committee that she received telephone calls from constituents for overflowing trash cans in the area.

Attorney Ryan M. Benson of the Association of Downtown Businesses said the event organizers will see to it that there will be adequate trash receptacles in the area for the event.

A Certificate of Liability Insurance must be provided to the City before the start of this event.

B Archie’s Bar and Grill, 2317 Division Street - Saturday, June 16, 2001, fund-raising event for American Diabetes Association and UW-Madison Hospital Transplant Unit.

Ald. Sevenich moved, Ald. Seiser seconded, for approval to extend the licensed premises for Archie’s Bar and Grill for a fund raising event to benefit the American Diabetes Association and UW-Madison Hospital Transplant Unit, on Saturday, June 16, 2001.

Craig "Archie" Hansen, owner of the establishment informed the Committee that this is a one-day event starting with a golf outing at 12:30 P.M. The golf outing attendees will then go to his establishment after the outing. The event starts around 5:30 P.M. and will go until 10:00 P.M. The tent is a back-up plan in case of rain. The area will be adequately secured by fencing. Entrance will be through the main door on Division Street and attendees can either go to the deck or under the tent. No one will be allowed to go into the tent from Church Street, Mr. Hansen said.

Captain Daubert said the Police Department sees no problem with this request.

7. Spud City Mash-ionals request:

A. Car Cruise - Friday, July 27, 2001, until 7:00 A.M., Saturday, July 28, 2001.

Chairman Phillips said this request is acceptable since there is no major effect on the City.

John Tomaszewski, one of the event organizers said this request was discussed with the Stevens Point Police Department and representatives from the County and Plover.

Ald. Sowieja moved, Ald. Sevenich seconded, to approve the request for a car cruise on Friday, July 27, 2001, starting at approximately 7:00 P.M. for the Spud City Mash-ionals.

Ayes, all; nays, none. Motion carried.

B. To close a portion of Prentice Street North directly in back of Holiday Inn from 10:00 A.M. Friday, July 27, 2001 until 7:00 A.M. Saturday, July 28, 2001.

Mr. Tomaszewski said this request is being made with safety in mind. There will be a lot of cars parked at the Holiday Inn and this will offer a nice invitation for trouble.

Mr. Tomaszewski also asked the 7:00 A.M. Saturday, July 28, 2001, be changed to 7:00 A.M. Sunday, July 29, 2001.

Ald. Walther moved, Ald. Sowieja seconded, to close that portion of Prentice Street North from North Point Drive to Schofield Avenue, from 10:00 A.M. Friday, July 27, 2001 until 7:00 A.M. Sunday, July 29, 2001.
Captain Daubert said the City had similar requests that have been approved in the past. No problem with the Police Department, the captain said.

8. Law Enforcement Torch Run Parade - Special Olympics - Thursday, June 7, 2001, starting at 2:00 P.M.

Captain Daubert noted this is the first year this request has come before the Committee. The Police Department sees no problem with this event.

Ald. Sevenich moved, Ald. Seiser seconded, for approval of the Special Olympics Law Enforcement Torch Run Parade on Thursday, June 7, 2001, starting at 2:00 P.M.

Ayes, all; nays, none. Motion carried.

9. Request to use Mathias Mitchell Public Square - Bike to Work Day - Portage County Bicycle and Pedestrian Advocacy Group - Tuesday, May 22, 2001, from 7:00 A.M. to 10:00 A.M.

Ald. Seiser moved, Ald. Walther seconded, to approve the request to use Mathias Mitchell Public Square for the Bike to Work Day event sponsored by the Portage County Bicycle and Pedestrian Advocacy Group, on Tuesday, May 22, 2001, from 7:00 A.M. to 10:00 A.M.

Ayes, all; nays, none. Motion carried.

10. Request to raise chickens and rabbits - 501 W. Maple Ridge Drive.

This request is from residents of the 9th ward. Ald. Nealis said the students from Jackson Elementary school come and visit the chickens. At times, the chickens travel to the school to visit the children and the staff. The alderman feels it is nothing but positive and rewarding to the owners.

A petition signed by approximately thirty four neighbors and friends who are in favor of the Fenlons raising chickens and rabbits was submitted with the request.

Two letters from neighboring property owners objecting to the request was filed with the City Clerk’s office.

Mr. Fenlon said there are benefits from having the chickens. It is a way to get rid of garden waste and the eggs are given to some friends.

Ald. Sowieja voiced his concern that the owners are already keeping a number of chickens and are just asking for permission now.

Mr. Fenlon said they did not know it was a problem since some of their friends are doing it too.

Ald. Sevenich stated similar requests were made and approved before.

Mr. Fenlon noted these are specialty chickens that their children can take to the county fair.

Ald. Seiser said she is a pro-chicken person but has a concern about approving and regulating a certain number of animals that can be kept by an owner.

Ald. Nealis feels the City’s animal ordinance needs updating.

Ald. Sowieja wonders if the complaints will be rectified immediately, like the complaint about the odor.

Mr. Fenlon said he always takes care of them and if there are any problems, he should be contacted directly.

Ald. Seiser moved for approval of the request to have chickens and rabbits at 501 W. Maple Ridge Drive.

The motion died due to a lack of second.

Ald. Sowieja moved, Ald. Walther seconded, to approve a 6-month permit with a stipulation of having a total of five chickens and two rabbits at 501 W. Maple Ridge Drive.

Chairman Phillips said if the City get complaints, the City has the right to make a change.

Mr. Fenlon commented that the complaints came from neighbors who do not like them.

11. Ordinance - amending 24.27 - City Citations and Bond Schedule.

Chairman Phillips said this item is being pulled from the agenda this month and will be in the June 11, 2001, Public Protection Committee agenda.

12. Inspection Report.

Ald. Sevenich moved, Ald. Seiser seconded, to accept the April 2001 Inspection Report and place it on file.

Ayes, all; nays, none. Motion carried.
