2. Salute to the flag and Mayor's
opening remarks.
Mayor Wescott wished everyone happy holidays. The Mayor reviewed a few of the City of Stevens Point's major accomplishments.
Mayor Wescott is grateful for all the hard work everyone had performed this year.
3. Approval of the minutes
of the Special Common Council meeting of November 18, 2002 and Regular Common Council meeting of November 18, 2002.

5. Plan Commission meeting
of December 2, 2002.
Ald. Rackow moved, Ald. Barr seconded, for approval of the Plan Commission minutes of December 2, 2002.

6. Resolution - Preliminary
Plat - Maybelle Erickson located on Della Street.
Lynn Markham, 1748 Briggs Street, thinks it is great that a number of people can come together and work out the
current compromise. Ms. Markham suggested in the future, the City of Stevens Point review the current subdivision
ordinance.
Amy Heart, 2132 McCulloch Street, hopes the Plan Commission will reserve the right to revisit this proposal if
the funding is not available. Ms. Heart also hopes the Plan Commission and Council will revisit the setback requirements
to strengthen the requirements. The City of Stevens Point's current setback is only 30 feet while the State of
Wisconsin is 75 feet and Portage County's setback is 100 feet.
Ald. Rackow moved, Ald. Barr seconded, for adoption of the resolution.
Ald. Seiser stated whatever is approved tonight will remain in effect. The development this close to the water
is not a good idea. The alderperson is concerned with the fact that the cul-de-sac is inconsistent with the subdivision
code. We have already acknowledged that the City has a very lenient ordinance as far as developing on water.
Ald. Filipiak is concerned with the lenient setback that the City of Stevens Point has. What would the path be
for the Council to postpone this until the setback requirements can be reviewed?
Mayor Wescott asked if this preliminary plat meets all the legal requirements under the law?
Director Gardner stated the proposed preliminary plat meets all the requirements of the City ordinance with the
exception of the extension of Della Street. The Director noted he called the Plan Commission's attention to the
fact that the City has a 30 foot setback requirement where Portage County's setback is 100 feet. Director Gardner
suggested the City should consider reviewing the City's setback requirement. The Director added that all the surrounding
lots are narrow lots and many of them are built with a 30 foot setback.
Ald. Filipiak asked if legally, can the proposal be postponed and then change the ordinance?
City Attorney Molepske stated when the preliminary plat was presented, the 30 foot setback was allowed. To now
change the setback requirement would be difficult. The City Attorney is not sure how you would develop this area
without a cul-de-sac.
Director Gardner reviewed the pros and cons of developing a cul-de-sac versus private drives. The main concern
is the access of emergency vehicles. With private drives, it would be hard for emergency vehicles to access the
development.
Ald. Barr feels this development is an asset to the Sixth District and to the community as a whole.
Ald. Filipiak agrees the setback requirement is too lenient.
Ald. Nealis feels this proposal was handled in a professional manner.
Ald. Rackow noted before the plan came before the Plan Commission, the developer had initially proposed a number
of more lots. As far as the setback is concerned, we have to follow the rules that are currently in place.
Mayor Wescott noted that the City is working very hard to keep lots 8-13 in their natural state.

7. Public hearing - amending:
A. Section 23.02(2)(b) of the Zoning Ordinance
- "B-2" Central Business Transition Zoning to allow retail.
B. Section 23.02(2)(c) of the Zoning Ordinance - "B-3" Central Business Zoning residential setback requirements,
was declared open by the Mayor.
As no one wished to speak, the Mayor declared
the public hearing closed.
8. Ordinance on the above.
Ald. Sowieja moved, Ald. Sevenich seconded, for adoption of the ordinance.

9. Public hearing - amending
Zoning Ordinance to rezone the former Lullabye site at 1017 Third Street from AM-1" Light Industrial to AB-2"
Central Business Transition, was declared open by the Mayor.

Ald. Nealis is pleased the vacation benefit for the Police Chief was brought before the Personnel Committee and
Council.

15. Special Personnel Committee

Ald. Sowieja moved, Ald. Barr seconded, for approval of the Special Personnel Committee minutes of December 16,
2002.

16. Ordinance - Mayor's
salary.
Mayor Wescott explained the reason the ordinance is back this evening is that last month, the ordinance setting
the Mayor's salary did not pass by sufficient number of votes.
Ald. Rackow moved, Ald. Barr seconded, for adoption of the ordinance - Mayor's salary as presented.
Ald. Filipiak asked if the ordinance presented is what was approved by the Personnel Committee or is it Ald. Rackow's
amended ordinance?
Ald. Rackow noted the ordinance approved by the Personnel Committee in November was for a 0% increase for the Mayor's
salary in 2004. The amendment to the ordinance to increase the Mayor's salary by 1.5 % for 2004 was made at the
November Council meeting. Due to the 7 to 3 vote on the amendment, the ordinance did not pass successfully.
City Attorney Molepske said the generic item on the agenda is Ordinance - Mayor's salary. If this is what you are
proposing as the ordinance, as opposed to what came out of Personnel Committee, the Attorney sees no reason why
the Council cannot proceed on that action. If someone wants to amend this action up or down that is fine.
Mayor Wescott said the motion tonight would reflect the salary structure that is outlined in the ordinance presented
this evening.
Ald. Filipiak noted the motion made tonight is not what the Personnel Committee approved last month. The ordinance
presented this evening is what was approved by a 7 to 3 vote last month.
Mayor Wescott replied, that is correct.
Ald. Filipiak reiterated that he supports what the Personnel Committee approved not what is being presented this
evening.
Ald. Barr asked what will happen if the ordinance does not pass this evening?
Mayor Wescott said if at least nine Council members do not vote in favor of the ordinance, the ordinance would
be directed back to the Personnel Committee for review in January.

17. Ratification of the
2003-2004 Tentative Agreement with the Stevens Point Police Officers' Organization.
Ald. Molski moved, Ald. Rackow seconded, to ratify the 2003-2004 Tentative Agreement with the Stevens Point Police
Officers' Organization.
Ald. Rackow pointed out the agreement will take effect for 2003-2004. The cooperation of Stevens Point Police Officers'
Organization is commendable.

20. Board of Park Commissioners
meeting of December 4, 2002.
Ald. Sowieja moved, Ald. Walther seconded, for approval of the Board of Park Commissioners minutes of December
4, 2002.
Ald. Seiser thanked the Park Commissioners for their good intent in dealing with the noise concerns in the City
parks.

21. Board of Water and Sewage
Commissioners meeting of December 9, 2002.
Ald. Molski moved, Ald. Sevenich seconded, for approval
of the Board of Water and Sewage Commissioners minutes of December 9, 2002.
Ald. Phillips asked what is the amount of the water rate increase?
Mayor Wescott said the water rate is state regulated by the Public Service Commission.
Director Disher said the rate for small residential is 15%, large residential is 15%, commercial is 15%, and public
authority is 1% to 6%.
Mayor Wescott asked what will the average residential customer's increase be? Would it be about $2.00 to $3.00
increase quarterly?
Director Disher said that is correct.
Ald. Phillips recalled giving the approval for the Commission to go to the State and ask for a 12% increase.
Director Disher said the State determined that a 12% increase would not make enough money to cover the operating
costs.
Ald. Phillips asked how much more money will be made than last year?
Director Disher replied about $300,363.00.
Ald. Phillips is concerned the rates are going up too rapidly. First, the meter rate increased and now the water
rate is increasing.
Director Disher said the water rate has not increased for ten years.
Ald. Phillips stated the sewage rate already increased two or three times.
Director Disher said the sewage rate increases were to help pay for the $13 million loan for the sewage plant.

Ald. Sevenich moved, Ald. Seiser seconded, for adoption of the ordinance.
Ald. Sowieja asked why are we asking for this increase?
Director Disher stated this amount was changed about two years ago. For some reason this amount was missed. All
we are doing is rectifying what should have been typed two years ago.
Mayor Wescott noted we simply are correcting a typo.

Ald. Filipiak asked if the current Directors are the only candidates?
Mayor Wescott stated the positions are not open. The Mayor is recommending reappointment of the four Directors.
The Directors have dedicated long hard hours to accomplish the goals that are set for them. This is not a gift,
the Directors have earned the reappointments.

Ald. Phillips moved, Ald. Moore seconded, for confirmation of the appointments of the Election Officials/Pollworkers
for 2003-2004.
Ald. Filipiak asked what standards are used to determine the list of pollworkers?
Clerk Zdroik stated in November before the appointment of the election officials, the list is sent to the Democratic
and Republican Party Chairs for review. The list of election workers actually comes from the Party Chairmen.
Ald. Filipiak questioned why the Green Party is not represented.
Clerk Zdroik stated the Democratic and Republican Parties are the two prominent parties in the City of Stevens
Point.
Ald. Rackow said his understanding is it is not easy to get people to work on election day. The alderperson encouraged
anyone interested in performing these duties should contact the City Clerk's Office.
Ald. Nealis added the pollworkers work a very long day.
Clerk Zdroik said the election workers usually put in an average of 15 hours per election day.
Ald. Nealis asked what the election workers are paid per election?
Clerk Zdroik replied they are paid $100.00 per election day. The Chairman receives an extra $15.00. The two officials
returning the election materials at the end of day each receive an extra $10.00.

Josh Stolzenburg, 2216 Division Street Apt B, is a member of a group of concerned citizens of Stevens Point opposing
war. Mr. Stolzenburg said a resolution stating an opposition to the United States Government's plans with Iraq
will be submitted to the City Clerk this week.
Eric McGinley, 2216A Division Street, expressed the concern for the citizens of Stevens Point as to the best route
concerning the violent actions of war.
Ald. Filipiak congratulated all the students who graduated from the University of Stevens Point this past Saturday.
