2. Salute to the flag and Mayor's opening remarks.

Mayor Wescott congratulated Comptroller-Treasurer Schlice for his recertification under the Certified Municipal Treasurer program.

Mayor Wescott said it is clear as most are already aware of Wisconsin's long term financial troubles have yet to be addressed. Wisconsin lawmakers have not yet solved the state's financial problem.

3. Approval of the minutes of the Regular Common Council meeting of June 17, 2002, and Special Common Council meeting of July 1, 2002.

Ald. Phillips moved, Ald. Rackow seconded, for approval of the regular Common Council minutes of June 17, 2002, and the Special Common Council minutes of July 1, 2002.

Roll Call: Ayes all.
Nays none. Motion carried.

4. *Persons who wish to address the mayor and council on specific agenda items other than a "Public Hearing" must register their request at this time. 5. Ordinance amending Chapter 17, Cable Communications Regulatory Ordinance.

Ald. Rackow moved, Ald. Barr seconded, for adoption of the ordinance amending Chapter 17, Cable Communications Regulatory Ordinance.

Roll Call: Ayes: Ald. Sevenich, Walther, Filipiak, Sowieja, Barr, Rackow, Molski, Nealis, Phillips, Moore.
Nays: None. Motion carried.

6. Resolution authorizing a Second Amendment to the Contribution and Cooperation Agreement relating to the Edgewater Manor Project.

Mayor Wescott said this item is being pulled per Comptroller-Treasurer Schlice and City Attorney Molepske's request.

7. Plan Commission meeting of July 1, 2002.

Ald. Nealis moved, Ald. Phillips seconded, to approve the Plan Commission minutes of July 1, 2002.

Roll Call: Ayes all.
Nays none. Motion carried.

8. Public hearing - amending Zoning Ordinance which would classify 2108 Patch Street to 2240 Patch Street, as AB-1" Neighborhood Business Zoning, was declared open by the Mayor.

Joan Lecher, 2148 Patch Street, feels the rezoning on Patch Street will create spot zoning.

Mayor Wescott declared the public hearing closed.

9. Ordinance on the above.

Ald. Rackow asked if the ordinance is approved as presented, will it include or exclude 2240 Patch Street?

Director Gardner said it would exclude 2240 Patch Street.

Ald. Sowieja moved, Ald. Phillips seconded, for adoption of the ordinance as presented.

Roll Call: Ayes: Ald. Moore, Phillips, Nealis, Molski, Rackow, Barr, Sowieja, Filipiak, Walther, Sevenich.
Nays: None. Motion carried.

10. Public hearing - request of Beechnut Grove LLC, 640 Second Street North, to construct an apartment complex, as a Conditional Use, was declared open by the Mayor.

As no one wished to speak, the Mayor declared the public hearing closed.

11. Resolution on the above.

Ald. Sowieja moved, Ald. Walther seconded, for adoption of the resolution.

Ald. Filipiak is not impressed with the plan to construct an apartment complex as a conditional use.

Director Gardner stated the requested construction area is for the land that is already disturbed. The current area that has not been touched will remain the same.

Ald. Nealis admires the work of the City staff to preserve the natural environment yet able to proceed with the development.

Roll Call: Ayes: Ald. Sevenich, Walther, Sowieja, Barr, Rackow, Molski, Nealis, Phillips, Moore.

12. Public hearing - request to operate a Boys and Girls Club at 1007 Ellis Street, as a Conditional Use, was declared open by the Mayor.

Kevin Quevillon, Executive Director of the Boys and Girls Club, was present for any questions.

Mayor Wescott declared the public hearing closed.

13. Resolution on the above.

Ald. Molski moved, Ald. Nealis seconded, for adoption of the resolution.

Roll Call: Ayes: Ald. Moore, Phillips, Nealis, Molski, Rackow, Barr, Sowieja, Filipiak, Walther, Sevenich.
Nays: None. Motion carried.

14. Ordinance - Annexation - Charles J. and Rita R. Pitsch property located at 4034 Kennedy Drive - 1.182 acres.

Ald. Molski moved, Ald. Sevenich seconded, for adoption of the ordinance.

Roll Call: Ayes: Ald. Sevenich, Walther, Filipiak, Sowieja, Barr, Rackow, Molski, Nealis, Phillips, Moore.
Nays: None. Motion carried.

15. Public Protection Committee meeting of July 8, 2002.

Clerk Zdroik said the Police Department, Chairman Phillips and herself worked on an additional step to what is already being done now for the bartender's/operator's license applications. When the Police Department brings a letter recommending rejection of a license to the City Clerk, the Clerk will call the applicant telling him/her that he/she is being denied. The applicant is then given the opportunity to talk to one of the Captains at the Police Department before a rejection letter would be sent to them. This gives the applicant an opportunity to explain their situation.

Clerk Zdroik reported from January, 2002 to July, 2002, the City Clerk's Office received 165 new bartender/operator applications and 152 renewal applications for a total of 317. Out of the 317 applications, only ten rejection letters were sent.

Ald. Philips moved, Ald. Barr seconded, for approval of the Public Protection Committee minutes of July 8, 2002, with item #1E and item #1D pulled for further discussion.

Ald. Rackow asked if a possible option could be that the applicant fill out another application to eliminate the uncertainty?

Chief Carpenter said when the City Clerk notifies the applicant that there is a problem with the application, the applicant should take the initiative to contact the Police Department. The Chief or one of the Captains will review the application with the applicant. At that point, the police will rely on the information given by the applicant whether or not the applicant has been truthful from the start, unintentional omission or was intending to deceive. The Police Department does check out of state when performing the background checks.

Ald. Phillips moved, Ald. Sowieja seconded, to deny the operator's/bartender's license applications for Sara J. Schillinger and Marty Joseph Slowinski.

Nays: Ald. Filipiak, Sowieja, Molski, Nealis.
Ayes - 6. Nays - 4. Motion carried.

The transfer of "Class B" Beer and Liquor license, Shannon Rae Myers, 237 Union Street, Stevens Point, WI for Jo Jo's Lounge, 5110 Main Street, Stevens Point, WI effective July 16, 2002, previously owned by Diane Aldrich was withdrawn by Shannon R. Myers.

16. Board of Public Works meeting of July 8, 2002.

Ald. Sevenich moved, Ald. Molski seconded, for approval of the Board of Public Works minutes of July 8, 2002.

Ron Siclovan is a representative from Fabco who represent the Caterpillar 143H. Mr. Siclovan understands it is the City's policy to stream line equipment purchases. The comments from the Board of Public Works department were the Caterpillar 143 was the best over and all purchase from delivery to disposal cost wise for the City. The recommendation was then made based on stream lined purchases to buy the John Deere. Is that really in the best interest of the City?

Glen Rogowski, Brooks Tractor Inc. representing John Deere, provided 19 out of the 20 specifications the City required plus provided the lowest bid. The city's current operators were pleased with the equipment.

Director Van Alstine said currently, the City has a 1998 John Deere. The equipment operators are already familiar with John Deere equipment. At this point, the Director does not feel the top of the line Caterpillar is necessary.

Ald. Rackow asked how many graders does the City have?

Director Van Alstine replied, two.

17. Preliminary Resolution - replacement of sanitary sewer laterals - Reserve, Fremont and Chase Streets from Clark Street to Main Street.

Ald. Rackow moved, Ald. Sowieja seconded, for adoption of the preliminary resolution for the replacement of sanitary sewer laterals on Reserve, Fremont and Chase Streets from Clark Street to Main Street.

Roll Call: Ayes: Ald. Sevenich, Walther, Filipiak, Sowieja, Barr, Rackow, Molski, Nealis, Phillips, Moore.
Nays: None. Motion carried.

18. Ordinance - Traffic:

Ald. Barr moved, Ald. Molski seconded, for approval of the Finance Committee minutes of July 8, 2002.

20. Personnel Committee meeting of July 8, 2002.

Ald. Rackow moved, Ald. Molski seconded, for approval of the Personnel Committee minutes of July 8, 2002.

21. Board of Park Commissioners meeting of July 3, 2002.

Ald. Rackow moved, Ald. Sowieja seconded, for approval of the Board of Park Commissioners minutes of July 3, 2002, with item #3 pulled for further discussion.

Roll Call: Ayes all.
Nays none. Motion carried.

Amanda Kotolski, 5653 Jurgella Lane, opposes the opening of the baby pool from 10:00 a.m. to 12:00 p.m. The top priority during this time is to conduct swim lessons. Currently, the pool is open from 1:00 p.m. to 4:00 p.m. and 5:00 p.m. to 8:00 p.m. Opening the baby pool during the hours of the swim lessons will only interfere with the lessons.

Ald. Nealis is concerned with the conflicting hours and fee structure of opening the baby pool during the morning hours. The City has three additional parks the children can swim at.

Ald. Nealis moved, Ald. Filipiak seconded, to deny the usage study to open the wading pool from 10:00 a.m. to Noon, Monday through Friday, on a trial basis.

Ald. Nealis asked if the opening of the baby pool is feasible?

Director Schrader feels the baby pool should remain closed during the time of swim lessons in the main pool. Opening the baby pool will create a distraction from the swim lessons. The parents are not even allowed in the area during swim lessons.

Ald. Barr supports Ald. Nealis' motion primarily based on the testimony of the Parks Director and staff members.

Ald. Rackow asked if the Parks Director is able to collect the components of the proposal in a speedy fashion, is it possible to return this issue by the August meeting?

Mayor Wescott noted by the third Monday in August, the pool will be closing. Depending on the outcome of the motion, the Mayor feels the Council will have given Director Schrader and his staff clear direction.

Ald. Molski stated Director Schrader has already submitted a lengthy report on various swimming pools in the area. How much more research can the Director possibly do?

Ald. Walther asked if the request is approved, where will the funds to cover the costs come from?

Director Schrader said the funds would come from the part time salaries line item. Depending on the length of time the pool is open, that account would most likely be over budget.

Ald. Rackow moved, Ald. Phillips seconded, for approval of the Telecommunications Commission minutes of July 10, 2002.
