Regular City Council Meeting Minutes
January 19, 2004, 7:00 P.M.

Roll Call: Present: Ald. Sevenich, Walther, Markham, Seiser, Sowieja, Barr, Rackow, Molski, Stroik, Phillips, Moore

2. Salute to the flag and Mayor's opening remarks.

Mayor Wescott announced tonight the wonderful process of democracy is formally under way in the state of Iowa.

Mayor Wescott recited a quote from Martin Luther King Jr.'s Nobel Prize Acceptance Speech.

3. Approval of the minutes of the Regular Common Council meeting of December 15, 2003, and Special Common Council meeting of January 12, 2004.

Ald. Walther moved, Ald. Markham seconded, for approval of the Regular Common Council minutes of December 15, 2003, and the Special Common Council minutes of January 12, 2004.

Roll Call: Ayes all.
Nays none. Motion carried.

4. *Persons who wish to address the mayor and council on specific agenda items other than a "Public Hearing" must register their request at this time. Those who wish to address the Common Council during a "Public Hearing" are not required to identify themselves until the "Public Hearing" is declared open by the Mayor.

5. Plan Commission meeting of January 5, 2004.

Ald. Seiser moved, Ald. Phillips seconded, for approval of the Plan Commission minutes of January 5, 2004.

Roll Call: Ayes all.
Nays none. Motion carried.

6. Public hearing - amending zoning ordinance which would classify 1101 Koch Street as "R-3" Single Family Zoning from "M -1" Heavy Industrial Zoning, was declared open by the Mayor.

As no one wished to speak, the Mayor declared the public hearing closed.

7. Ordinance on the above.

Ald. Sowieja moved, Ald. Barr seconded, for adoption of the ordinance.

Ald. Markham noted there are six homes in this area that are zoned "M-1" Heavy Industrial Zoning. At this time, only one owner wants to rezone to "R-3" Single Family Zoning. The alderperson does not have a problem rezoning the entire area to Single Family Zoning. The alderperson does have a concern approving the rezoning for just one lot and creating spot zoning.

Mayor Wescott stated this was an issue at the Plan Commission meeting. The owner of 1101 Koch Street is on a strict time line for financial issues. It is the intent of the Plan Commission to have staff contact the remaining property owners to accomplish Single Family Zoning for the entire area.

Nays: Ald. Markham.

8. Public Protection Committee meeting of January 12, 2004.

Ald. Phillips moved, Ald. Seiser seconded, for approval of the Public Protection Committee minutes of January 12, 2004.

Ald. Stroik asked that item #3 be pulled for further discussion.

Roll Call: Ayes all.
Nays none. Motion carried.

Ald. Stroik feels the issue of licensing all the animals in the City needs to be discussed. The alderperson has a hard time seeing raising these types of animals in the City.

Ald. Rackow said if the Council approves this request, the Council will approve what is already happening.

Ald. Phillips said the neighbors do not have a problem with Mr. Haessly raising these animals. The area in which the animals are kept is clean. In one year from now if there is a problem the Council will deal with it at that time.

Mayor Wescott said the request of Jeff Haessly has a review date of December 31, 2004.

Ald. Rackow moved, Ald. Phillips seconded, to approve the request of Jeff Haessly, 2149 Rice Street, to raise five rabbits, nine ducks, and four bantees until December 31, 2004.

Roll Call: Ayes: Ald. Moore, Phillips, Molski, Rackow, Barr, Seiser, Markham, Walther, Sevenich.
Nays: Stroik, Sowieja.
Ayes - 9. Nays - 2. Motion carried.

9. Board of Public Works meeting of January 12, 2004.

Ald. Walther moved, Ald. Moore seconded, for approval of the Board of Public Works minutes of January 12, 2004.

Roll Call: Ayes: Ald. Sevenich, Walther, Markham, Seiser, Sowieja, Barr, Rackow, Molski, Stroik, Phillips, Moore.
Nays: None. Motion carried.

10. Finance Committee meeting of January 12, 2004.

Ald. Barr moved, Ald. Sowieja seconded, for approval of the Finance Committee minutes of January 12, 2004.

Roll Call: Ayes: Ald. Sevenich, Walther, Markham, Seiser, Sowieja, Barr, Rackow, Molski, Stroik, Phillips, Moore.
Nays: None. Motion carried.

11. Resolution - designating authorized depositories.

Ald. Stroik moved, Ald. Molski seconded, for adoption of the resolution.

Roll Call: Ayes: Ald. Moore, Phillips, Stroik, Molski, Rackow, Barr, Sowieja, Seiser, Markham, Walther, Sevenich.
Nays: None. Motion carried.

12. Personnel Committee meeting of January 12, 2004.

Ald. Rackow moved, Ald. Seiser seconded, for approval of the Personnel Committee minutes of January 12, 2004.

Roll Call: Ayes: Ald. Moore, Phillips, Stroik, Molski, Rackow, Barr, Sowieja, Seiser, Markham, Walther, Sevenich.
Nays: None. Motion carried.

13. Board of Park Commissioners meeting of January 7, 2004.

Ald. Seiser moved, Ald. Moore seconded, for approval of the Board of Park Commissioners minutes of January 7, 2004.

Ald. Seiser noted the updating of the outdoor plan is complete. The alderperson does have some concerns with the plan. The document is completed and will be voted on next month.

Mayor Wescott clarified the master comprehensive outdoor park plan will go to the Plan Commission next month. Depending on what the Plan Commission decides, the plan may or may not be before the Council next month.

Ald. Stroik commended the Park Commission and Parks Department for an outstanding plan.

14. Board of Water and Sewage Commissioners meeting of January 12, 2004.

Ald. Phillips moved, Ald. Stroik seconded, for approval of the Board of Water and Sewage Commissioners minutes of January 12, 2004.

Roll Call: Ayes: Ald. Sevenich, Walther, Markham, Seiser, Sowieja, Barr, Rackow, Molski, Stroik, Phillips, Moore.
Nays: None. Motion carried.

15. Reports:

Police and Fire Commission meeting of January 13, 2004.
Comptroller-Treasurer's report - November 2003.
Transportation Commission meeting of January 15, 2004.

Ald. Molski moved, Ald. Walther seconded, to accept the reports and place them on file.

Ald. Seiser does not understand what the Point Plus policy update is.

Ald. Walther said the Point Plus transportation is a call in service for disabled riders. The TDP recommended updating the rules for this service. The rules were rewritten and some standards were set to begin February, 2004.

Mayor Wescott said most of the changes are procedural, and operational guidelines.

Ald. Rackow said the policy was presented to the major users of the Point Plus service.

Ald. Walther said one of the main reasons for the update was to deal with cancellations and no shows.

Ald. Rackow noted the offenders will get three chances and then they may not be welcome to use the service anymore.
