Finance Committee Minutes
April 12, 2004 at 6:30 P.M.


PRESENT: Chairman Barr, Ald. Rackow, Phillips, Molski and Walther

1 - ASSESSOR'S REPORT

Motion made by Ald. Rackow, seconded by Ald. Phillips to approve the Assessor's Report and place it on file.

Ayes: All Nays: None Motion carried.

2 - CONSIDERATION OF CLAIM - MARY YACH

Chairman Barr stated that Sentry has recommended denial of the claim.

Motion made by Ald. Phillips, seconded by Ald. Molski to deny the claim for Mary Yach.

Ayes: All Nays: None Motion carried.

3 - REQUEST FOR ADDITIONAL OVERTIME EXPENDITURE - POLICE DEPARTMENT

C/T Schlice stated this was discussed a couple of months ago when we were changing the fee structure for housing licenses and a concern was brought up by the Alderperson. They have now determined what the overtime would cost and that it would be offset from the additional revenues that we will receive from the housing licenses. We need a motion to approve the additional expenditure offsetting the cost from the housing license revenues.

Motion made by Ald. Phillips, seconded by Chairman Barr to approve the request for the additional overtime expenditure for the Police Department to be funded from the housing license revenue.

Ald. Phillips questioned if this would be in the budget next year.

C/T Schlice stated that they have requested a two-year program, so it would come through the normal budget cycle.

Mayor Wescott commented that we need to develop ways to "measure" the success of the program to see how successful it really is because it is not measured on tickets alone.

Ald. Markham stated that she is happy to see this and it is very good timing. She feels that educating the people will be more effective in the long-term.

4 - CLAIM FOR RECOVERY OF UNLAWFUL TAXES

A. WYNDMERE ESTATES B. STEVENS POINT HOUSING, LLC.

Assessor Kuehn stated that the property owners filed a claim for recovery for unlawful taxes, which she recommends be denied. There is a 90 day time frame in which to take action on this claim, so we need to act on it this month. Their claim is under section 74.35 of the statutes for recovery of unlawful taxes. In order to qualify for a claim under that particular section, they have to experience on of the following items: clerical error made on the assessment, the Assessor included real property that was not there, the property is exempt from taxation, the property is not located in our district, a double assessment was made or a arithmetic or transposition error was made. None of these circumstances are present in this claim.

Attorney Molepske agreed with the Assessor. He stated that the claims need to be denied because they never went in front of the Board of Review. He further elaborated on other reasons to deny the claim.

Motion made by Ald. Rackow, seconded by Chairman Barr to disallow the claim for recovery of unlawful taxes for Wyndmere Estates.

Ayes: All Nays: None Motion carried.

Motion made by Ald. Phillips, seconded by Ald. Rackow to disallow the claim for recovery of unlawful taxes for Stevens Point Housing, LLC.

Ayes: All Nays: None Motion carried.

5 - APPROVAL OF PAYMENT OF CLAIMS

Motion made by Ald. Molski, seconded by Ald. Rackow to approve the payment of claims in the amount of $433,071.42.

The claims were briefly discussed.

Ayes: All Nays: None Motion carried.
