PRESENT: Chairman Barr, Ald. Molski, Walther, and Moore

EXCUSED: Ald. Stroik

1 - ASSESSOR'S REPORT

Motion made by Ald. Molski, seconded by Ald. Walther to accept the report of the Assessor and place it on file.

Ayes: All Nays: None Motion carried.

2 - CONSIDERATION OF CLAIM - MARY ROSEK

Motion made by Ald.. Moore, seconded by Ald.. Barr to deny the consideration of claim for
Mary Rosek.

Ayes: All Nays: None Motion carried.

3 - FUNDING FOR CITY PORTION OF EMS SYSTEM STUDY

Motion made by Ald.. Molski, seconded by Ald.. Walther to approve the funding for the City's portion of the EMS System Study not to exceed $12,500.

Ayes: All Nays: None Motion carried.

4 - CORRECTION OF ERROR - PERSONAL PROPERTY TAX - EMY J'S

Assessor Kuehn stated there was an error in filing of the paperwork by the accountant for Emy J's which was not found until after the records had been closed. The State recognizes that errors do occur and has made a provision for this in section 70.43. She encourages the approval to correct the error.

Motion made by Ald.. Walther, seconded by Ald.. Barr to approve the correction of the error on the personal property tax for Emy J's.

Ayes: All Nays: None Motion carried.

5 - 1ST QUARTER ROOM TAX REPORT

C/T Schlice stated we are tracking as anticipated. There usually is not a lot of expenses in the first quarter.

Motion made by Ald.. Barr, seconded by Ald.. Molski to accept the first quarter room tax report and place it on file.

Ayes: All Nays: None Motion carried.

6 - APPROVAL OF PAYMENT OF CLAIMS

Motion made by Ald.. Molski, seconded by Ald.. Barr to approve the payment of claims in the amount of $778,795.89.

Ayes: All Nays: None Motion carried.

7 - ADJOURN INTO CLOSED SESSION (APPROXIMATELY 6:35 P.M.) PURSUANT TO WISCONSIN STATE STATUTE 19.85(1)(G) TO CONFER WITH CITY ATTORNEY WITH RESPECT TO LITIGATION - K-MART AND WORZALLA

Motion made by Ald.. Molski, seconded by Ald.. Moore to approve adjourning into closed session at 6:55 p.m., pursuant to Wisconsin State Statute 19.85(1)(g).

Ayes: Ald.. Barr, Molski, Walther and Moore Nays: None Motion carried.

8 - RECONVENE INTO OPEN SESSION (APPROXIMATELY 10 MINUTES AFTER ADJOURNING INTO CLOSED SESSION) FOR POSSIBLE ACTION ON ABOVE

Motion made by Ald.. Molski, seconded by Ald.. Barr to reconvene into open session at 7:10 p.m.

Ayes: Ald.. Barr, Molski, Walther and Moore Nays: None Motion carried.

9 - PERSONAL PROPERTY TAX SETTLEMENT - K-MART

Motion made by Ald.. Molski, seconded by Ald.. Barr to accept the 2001 personal property tax settlement at 70% and to authorize the City Attorney, Comptroller and Mayor to negotiate the 2002 personal property tax settlement.

Ayes: All Nays: None Motion carried.

10 - LITIGATION SETTLEMENT - WORZALLA

Motion made by Ald.. Walther, seconded by Ald.. Molski the authorize the City Attorney and the Comptroller/Treasurer to settle the Worzalla litigation for a maximum of $2,500.

Ayes: All Nays: None Motion carried.
