ALSO PRESENT: Mayor Wescott; C/T Schlice; City Attorney Molepske; City Clerk Moe; Directors Gardner, Schrader, Halverson; Assessor Kuehn; Fire Chief Barnes; Chief Morris; Capt. Ruder; Surveyor Hild; City Engineer Saunders; Ald. Sevenich, Wiza, Barber, Robinson, Slowinski, Trzebiatowski; Gene Kemmeter; Reid Rocheleau; Mary Ann Laszewski; Pete Ananiadis; Andrew Halverson; Dan Johnson; Norm Myers; Amy Heart; Stephen Decker; Doug Stingle

1. ASSESSOR'S REPORT.

Motion made by Ald. Moore, seconded by Ald. Hanson to accept the report of the Assessor and place it on file.

Ayes: All Nays: None Motion carried.

2. CONSIDERATION OF CLAIM - ERIC KRANSKI.

Motion made by Ald. Moore, seconded by Ald. Molski to deny the claim for Eric Kranski.

Ayes: All Nays: None Motion carried.

3. SALE OF LAND - CORNER OF MICHIGAN AND MARIA.

C/T Schlice stated that the prior owner has right of first refusal under original purchase agreement. We have received verbal approval and will receive written approval prior to closing.

Director Gardner suggested adding one more additional condition to require the City review any changes in design.

Motion made by Ald. Stroik, seconded by Ald. Moore to approve the sale of land to UWSP for $1.00.

Ayes: All Nays: None Motion carried.

4. APPROVAL OF PAYMENT OF CLAIMS.

Motion made by Ald. Stroik, seconded by Ald. Molski to approve the payment of claims in the amount of $373,626.43.

The claims were discussed.

Ayes: All Nays: None Motion carried.

5. ADJOURN INTO CLOSED SESSION (APPROXIMATELY 6:30 P.M.) PURSUANT TO WISCONSIN STATE STATUTE #19.85(G) OR THE PURPOSE OF CONFERRING WITH LEGAL COUNSEL WITH RESPECT TO LITIGATION (ANR PIPELINE).

Motion made by Ald. Walther, seconded by Ald. Moore to approve adjourning into closed session at 6:15 p.m. pursuant to Wisconsin State Statute 19.85 (g).

Ayes: Ald. Molski, Walther, Moore, Stroik and Hanson Nays: None Motion carried.

6. RECONVENE INTO OPEN SESSION (APPROXIMATELY 15 MINUTES AFTER ADJOURNING INTO CLOSED SESSION FOR POSSIBLE ACTION ON ABOVE).

Motion made by Ald. Molski, seconded by Ald. Moore to reconvene into open session at 6:40 p.m.

Ayes: Ald. Molski, Walter, Moore, Stroik and Hanson Nays: None Motion carried.

Motion made by Ald. Stroik, seconded by Ald. Moore to approve the City to vigorously defend the lawsuit from ANR Pipeline.

Ayes: All Nays: None Motion carried.
