1. Recommendation on license list:

A. New and Renewal Operator's (Bartenders) Licenses.

Ald. Trzebiatowski moved, second by Ald. Slowinski, to approve the thirty-four new operator's and ten renewal licenses. Ayes, all; nays, none; motion carried.

B. "Class B" Beer and Liquor to Melendez, Inc., at El Mezcal.
C. Class "B" Beer and Class "C" Wine to Kristine H. Klish at Stonecrop Organics.

Ald. Trzebiatowski moved, second by Ald. Heart, to approve the transfer of "Class B" Beer and Liquor to Melendez, Inc., 701 Owl Lane, operating at El Mezcal, 5420 Windy Lane Suite D, and a Class "B" Beer and Class "C" Wine to Kristine H. Klish, 7038 Pleasant Drive, Almond, at Stonecrop Organics, 3233 Business Park Drive. Ayes, all; nays, none; motion carried.

D. Change of Agents:

1) WHG Real Estate North LLC, at Applebee's Neighborhood Grill and Bar to Mike Bablitch.
2) MAK Petroleum One, Inc., at Stevens Mobil to Autumn L. Zingler.

Ald. Slowinski moved, second by Ald. Barber, to approve of the Change in Agents for WHG Real Estate North LLC, at Applebee's Neighborhood Grill and Bar to Mike Bablitch; MAK Petroleum One, Inc., at Stevens Mobil to Autumn L. Zingler; PH Wausau LLC, at Pizza Hut to Sara Cysiewski; Portage County Youth on Ice, at Ice Hawk Arena to Mark Cychosz; Tim Schertz Inc., at Nikki's on the Square adding Ashlie Jaskolski; Stevens Point Elk's Club #641, at Elk's Club to Joseph A. E. Special Class "B"/"Class B" Retailer's Licenses:

1) St. Joseph's Parish for the Parish Picnic on June 1, 2 and 3, 2007.
2) St. Peter's Parish Picnic Committee for the Parish Picnic on June 9 and June 10, 2007.
3) Msgr. John R. McGinley Council 1170 Knights of Columbus for the Knights of Columbus Picnic on June 24, 2007 at Bukolt Park.

Jamie Gebert, Main Street Manager, stated that this is the second year that we will be doing a micro-brewery beer tasting at the end of Crazy Days. Last year it went well. They will work with the Police Department to put in place all the necessary precautions like they did last year including checking ID's, officers and fencing around the Square.

Capt. Ruder said that Jamie works well the Police Department and they have had no problems in the past.

Ald. Barber moved, second by Ald. Stroik, to approve the six Special Class "B"/"Class B" Retailer's Licenses. Ayes, all; nays, none; motion carried.

2. Recommendation on 2007-2008 renewal license list - beer and liquor.

Capt. Ruder asked the Committee to consider granting the Northside Bar a six month license because of two alcohol violations this past year.

Ald. Stroik read a statement from Al Kawalske, Little Chubbies Vintage Blues & Chop House, that said he wished to withdraw his application submitted to the Stevens Point Common Council. He will resubmit it in the name of Blue Top Enterprises, LLC, with him, Al Kawalske, as the agent.

Ald. Stroik felt the easiest way to handle this would be to make a motion on all 55, pulling number 33, Little Chubbies, Vintage Chop House, number 54, the Northside Bar, and number 55 Johnny T's. Ald. Stroik moved, Ald. Barber seconded, approval of the license list for Beer and Liquor applications for 2007-2008, but pulling Little Chubbies Vintage Blues & Chop House, the Northside Bar, and Johnny T's Club Tropicana. Ayes, all; nays, none; motion carried.

Ald. Trzebiatowski moved, Ald. Slowinski seconded, to renew the Northside Bar with a six-month license instead of a one year license. Ayes, all; nays, none; motion carried.

3. Possible non renewal action on applicant John L. Timm's Combination "Class B" liquor and fermented malt beverage license on referral of Police Department Complaint.

City Attorney Molepske said this license had problems last year and was granted a six month license. The problems seem to have continued as noted in the complaint. He asked the committee to consider the non renewal of the license and make a motion to that affect and notify the applicant, John Timm, of this action and to have the due process hearing at the June 18th Common Council meeting at which time the whole board would make a decision.

Ald. Stroik moved, Ald. Trzebiatowski seconded, that the committee give notice of our intent to not renew Johnny T's license, 200 Isadore Street, Stevens Point, and that the Common Council afford a full hearing to the licensee on such issue of non renewal at its June 18, 2007, Council meeting.

Ald. Trzebiatowski noted that this week there were several articles about alcohol problems in the area. He would like this committee and the City to review underage violations and citations and possibly increase the fines so perhaps by doing this underage persons would think twice before they went out and started house parties and things of that nature.

Ald. Heart asked how many other similar instances have there been revoked/non renewal of a liquor license.

City Attorney Molepske said the last revocation was a bar downtown where there was drug dealing in the bathrooms. The last time the City moved to not renew a license was last year for non use and before that it was four or five years ago for non payment of liquor bills.

Call for the Vote: Ayes, all; nays, none; motion carried.

Don Woyak, asked the condition of their request.

Ald. Stroik said that it would be acted upon at next month's Public Protection meeting.

4. Parking conditions for Stevens Point Brewery's Rock the Brewery, June 9-10, 2007.

Ald. Barber moved, second by Ald. Slowinski, to approve the parking conditions for the Stevens Point Brewery's Rock the Brewery, June 9, 2007 as presented by the Police Department.

Ald. Barber asked if these were the same rules as the pervious year.

Capt. Ruder replied that they were.

Call for the Vote: Ayes, all; nays, none; motion carried.

5. Ordinance Amendment - Curfew.

Ald. Stroik stated the amendment would just bring the City's ordinance in line with the County and Plover.

Ald. Slowinski moved, second by Ald. Trzebiatowski, to approve of amending the curfew ordinance. Ayes, all; nays, none; motion carried.

6. Ordinance Amendment - Bond forfeiture for Open Intoxicants on a Public Way.

Removed from the Agenda to be discussed at a later date.

7. Recommendation of the April 2007 Inspection Report:
A. Construction Starts.
B. Violations.

Director Gardner stated that it was a good month and we stayed ahead of last year in terms of overall numbers.

Ald. Slowinski asked for more information on the 45 violations for improper use.

Director Gardner stated the number was special orders from this past fall that came due this spring and garage and other orders.

Ald. Stroik moved, Ald. Slowinski seconded, to approve the inspection report and have it placed on file. Ayes, all; nays, none; motion carried.
