2. Salute to the Flag and Mayor's opening remarks.

Mayor Halverson said the procedures for the new garbage collection system will be available shortly and delivery of the carts will be sometime in August.

3. Consideration of the minutes of the Regular Common Council meeting of June 16, 2008 and Special Common Council meeting of July 14, 2008.

Ald. Stroik moved, Ald. Molski seconded, approval of the regular
Common Council minutes of June 16, 2008 and Special Common Council minutes of July 14, 2008.

Item # 5 - Persons who wish to address the Mayor and Council

5. Persons who wish to address the Mayor and Council for up to three (3) minutes on a non-agenda item.

Mildred Neville, 1409 Franklin Street, said she is disturbed that Plan Commission members do not have the full details on items that they are voting on.

Reid Rocheleau, 408 Cedar Street, voiced his concerns on the way the cell tower on School District property was handled. He also voiced his concerns on the possible uses at the old dump site.

Ald. Trzebiatowski informed everyone this is the last night to watch the Council meeting on Channel 3. He is not certain what the new channel will be. The alderman noted that even with a digital converter, the local stations may still be out of reach.

6. Consideration and adoption of Meeting Rules of Conduct.

Mayor Halverson noted there was one minor change made to the Meeting Rules of Conduct.

Mildred Neville, 1409 Franklin Street, read a letter from Lyn Miller, 816 Prentice Street, who opposes the adoption of Meeting Rules of Conduct. The letter was placed on file.

Mildred Neville believes these rules violate Standing Rule 2.05. She said the proposed rules will not make people feel comfortable testifying. Ms. Neville feels the rules are not needed.

Reid Rocheleau, 408 Cedar Street, said the Meeting Rules of Conduct are not necessary. He believes the rules are an opportunity to curtail the public.

Mary Ann Laszewski, 1209 Wisconsin Street, said meeting rules are already covered in the Robert's Rules of Order. She said the Chair already has the authority to maintain order of a meeting. Ms. Laszewski said the adoption of the Meeting Rules of Conduct will limit public participation to three minutes.

City Attorney Molepske said the City does have Standing Rules by ordinance and they are also covered in the Robert's Rules of Order. He said time limits are common and additional time can be granted. The City Attorney stressed that written statements are encouraged. He said citizens are allowed to speak on every item.

Mayor Halverson said several members of the Plan Commission requested that rules be established after the last Plan Commission meeting. He said these rules would be in addition to the Robert's Rules of Order.

Ald. Wiza asked who requested these rules.

Mayor Halverson replied Commissioners Shannon, Feldman and Aldinger.

Ald. Wiza asked how they got involved because the memo on the Meeting Rules states it came from City staff.

Mayor Halverson said other associates of staff also wanted to maintain decorum at the meetings that they are involved with.

Ald. Wiza asked who the City staff members were.

Mayor Halverson replied Director Gardner, Director Euclide and Deputy Chief Dowling.

Ald. Wiza would like to know which City staff was involved with the implementation of the Meeting Rules.

Mayor Halverson said City staff includes the Directors and Department Heads.

Ald. Wiza asked if all the Directors and Department Heads agree with the rules.

Mayor Halverson replied, yes.

Ald. Wiza asked why no one put their name on the rules. He feels the rules will intimidate the public. The Alderman said it is the responsibility of the Chair to maintain the decorum.

Ald. Heart moved, Ald. Slowinski seconded, to table the consideration and adoption of the Meeting Rules of Conduct.

Ald. Heart said the proposed meeting rules are redundant. She said we already have the Robert's Rules of Order, city ordinance and state statute that govern the rules for meetings.

Ald. Brooks agrees the rules are intimidating for the public. He feels the public should be allowed more than three minutes for input.

Ald. Myers asked if the three minute rule will apply to all meetings.

City Attorney Molepske said we try to follow the Robert's Rules of Order. He said the Mayor and Chairmen do a good job running the meetings but at times not all the rules of order are followed. The Attorney said the Meeting Rules of Conduct will apply to all City meetings.

Ald. Myers feels more than three minutes for public input is needed at some of the meetings.

7. Consideration of minutes and actions taken at the Plan Commission meeting of July 7, 2008.

Mary Ann Laszewski, 1209 Wisconsin Street, stated the citizens of Stevens Point need to know if Spectra Print's ability to pay for their taxes is dependent on the sale of the parcels for the Business Park. She wanted to know if the parcels do not sell, does the City have financial assurance from Spectra Print that they will be able to handle the new TIF tax base.

Ald. Moore moved, Ald. Heart seconded, to accept the minutes and affirm the actions taken at the
Plan Commission meeting of July 7, 2008, with item #10 pulled for further discussion.

Roll Call: Ayes all.
Nays none. Motion carried.

Ald. Heart asked if the information on the developer's incentive will be available at the public hearing and what is the length of time for the TIF District.

Mayor Halverson replied the incentives will be in the form of a developer's agreement. He said it will be approximately 10 to 12 years for the project.

Director Gardner responded that this TIF District is a mixed use district. He said mixed use districts can be 20 years in length. The Director noted the District is always closed when all the bills have been paid. He said the developer's incentive is unknown because there may be an occasion when we will want to create a developer's agreement with a future developer.

Ald. Moore moved, Ald. Heart seconded, to approve item #10 of the Plan Commission meeting.

Roll Call: Ayes all.

8. Public Hearing - Request of Jim Siebers, 1201 West River Drive, to construct a Single Family Home as a conditional use using Traditional Neighborhood Overlay District Setback Requirements.

The public hearing was declared open by the Mayor.

Jim Siebers, 2142 Church Street, intends to build a home on this lot. He is requesting to extend the Traditional Neighborhood Development zoning to this lot. Mr. Siebers hopes to enhance the corner by building a home that is pleasing to West River Drive and West Cornell Street.

Mildred Neville, 1409 Franklin Street, asked if there are other properties that this zoning would be extended to. She also asked if this would extend the zoning as well as create the setbacks.

Director Gardner said this property is subject to a conditional use using Traditional Neighborhood Development.

As no one further wished to speak, the Mayor declared the public hearing closed.

9. Resolution on the above.

Ald. Molski moved, Ald. Trzebiatowski seconded, approval of the resolution for using Traditional Neighborhood setback requirements at 1201 West River Drive.

Ald. Wiza asked if the neighbors were notified.

Director Gardner replied, yes. He noted the notification to the neighbors is a courtesy and is not required by law.

10. Public Hearing - Request of Joseph Kozicki, 2608 Water Street, to operate a Recycling Operation as a conditional use.

The public hearing was declared open by the Mayor.

Reid Rocheleau, 408 Cedar Street, suggested placing the same conditions from the previous conditional use for the materials that can be accepted at this facility and the hours of operation.

Dave Quimby, 2832 Water Street, does not agree with the conditional use request. He is concerned that additional materials will be accepted at the new location.

Mayor Halverson stated Mr. Quimby distributed minutes from the Plan Commission meeting in which Director Gardner gave the reasons for changing permitted uses to conditional uses that would require review and allow neighborhood input.

Mary Ann Laszewski, 1209 Wisconsin Street, said this is a good time to change the zoning for these properties to commercial.

Joe Kozicki, 432 First Avenue South, has been in operation for two years without any complaints from the neighbors. He said he does not plan on making any changes to his operation.

As no one further wished to speak, the Mayor declared the public hearing closed.

11. Resolution on the above.

Ald. Stroik asked if Mr. Kozicki would object to adding the previous conditions for the hours of operation and the materials accepted.

Joe Kozicki said he would be happy to continue to operate under those conditions.

Ald. Stroik moved, Ald. Molski seconded, approval of the request to operate a Recycling Center as a conditional use adding the same conditions.

Ald. Slowinski asked if the semi parked on the site is considered outside storage.

Mayor Halverson said the semi has not been considered outside storage.

Ald. Myers asked if the Recycling Center is completely independent from the concrete plant.

Mayor Halverson said it is a separate business at the same site.

Ald. Stroik noted that Mr. Kozicki has conducted a great operation for the past two years.

Mayor Halverson said the City has not received any complaints. He noted this location will be further away from the residential homes.

12. Public Hearing - Request of Ed Rusin, 2608 Water Street, to operate a Concrete Plant as a conditional use.

The public hearing was declared open by the Mayor.

Cris Harris, 2817 Jefferson Street, voiced her concerns on increased traffic and safety of pedestrians.

Edith Pankowski, 2331 Aspen Lane, opposes the conditional use permit to operate a concrete plant at 2608 Water Street. She voiced her concerns on noise, traffic, hours of operation, quality of life and decreasing the assessed values of the neighboring properties.

Norma Rombalski, 3140 Whiting Avenue, is concerned with increased truck traffic and safety of the children and residents in this area.

Jane Witkowski, 2841 Water Street, voiced her concerns on water contamination, noise, dust, truck traffic, decreasing property values and damage to the roads. She encouraged the Council to deny this request.

Bonnie Quimby, 2832 Water Street, opposes a concrete plant in this area. She does not agree with the hours of operation of 6:00 a.m. to 6:00 p.m. Mrs. Quimby believes heavy industry belongs on the outskirts of the City.

Marion Kolinski, 2804 Water Street, voiced her concerns on traffic, noise, pollution and decreased property values.

Mary Ann Laszewski, 1209 Wisconsin Street, does not believe there will be an adequate buffer between the concrete plant and the residences. She also feels the neighbors should not have to provide the buffer for this business. Ms. Laszewski said the starting hours of operation are too early. She stated the industrial zoning was appropriate when this area was at the edge of the City but it now needs to be down-zoned.

Mildred Neville, 1409 Franklin Street, stated the general standard of a conditional use is that it will not be detrimental to the neighborhood. She said this development will clearly have a negative impact on the neighborhood.

Chris Piotrowski, 800 Whiting Avenue, stated Mr. Rusin has owned and paid taxes on this property since 1986. He said the City and the neighboring residents knew that something would be developed here at some time so they should have changed the zoning a long time ago. Mr. Piotrowski explained that conditional use simply means that certain criteria must be met.

Reid Rocheleau, 408 Cedar Street, said the property values of the surrounding properties will decrease. He said conditional uses do not have to be granted.

Dave Quimby, 2832 Water Street, stated there is plenty of heavy industrial land near Hwy. 10 and I39. He would like this item tabled for additional information. Mr. Quimby is concerned with noise, dust and truck traffic.

Ed Rusin, 1681 North Second Drive, said the City is growing and will have increased traffic. He said since he has owned the property, he has spent $282,307.17 to clean it. Mr. Rusin feels he is a good neighbor. He does not plan on having a large operation at this location but more competition would be beneficial to the community. Mr. Rusin said the nearest house is approximately 480' from the concrete plant.

As no one further wished to speak, the Mayor declared the public hearing closed.

13. Resolution on the above.

Ald. Brooks moved, Ald. Moore seconded, to deny the request of Ed Rusin to operate a Concrete Plant as a conditional use.

Ald. Wiza said most of the people that he spoke with would not be opposed to this project if further restrictions were in place. He feels that this project could still be completed with some additional work.

Ald. Stroik would rather see this postponed rather than a full denial. He agrees that more conditions need to be set.

Ald. Myers said the Council needs to listen to the neighboring citizens.

Ald. Trzebiatowski asked if there is anything limiting cement trucks from traveling on any city street.

City Attorney Molepske said they can use the streets to the closest point of their delivery.

Ald. Trzebiatowski explained that there are regulations that restrict the amount of dust from the concrete production.

Ald. Moore stated at the Plan Commission meeting, Mr. Rusin said 250 yards of concrete per hour could be produced. He said that means 25 trucks per hour could be coming and going.

Ald. Brooks received many calls of which everyone was against the Concrete Plant. He said his constituents are concerned with dust, traffic, noise, property value and safety.

14. Public Hearing - Request of WM Development LLC, 3101 Whiting Avenue, to construct Multiple Family Development as a conditional use.

The public hearing was declared open by the Mayor.

Tom Wood, Harris and Associates, said the main topic at the Plan Commission meeting was the access for this development. He said they have drafted an agreement with the railroad for a viable access drive. Mr. Wood said they originally had two options for a secondary access for emergency purposes. He said the first option was denied so they now need to apply to the County Highway Department to run an emergency access drive to the right-of-way of River View Avenue.

Reid Rocheleau, 408 Cedar Street, said he does not feel they should use common property for a private benefit.

Mary Ann Laszewski, 1209 Wisconsin Street, reviewed the number of some of the rentals and market for rentals in our community.

Norma Rombalski, 3140 Whiting Avenue, has environmental concerns with this development. She said the property includes a wetland. Ms. Rombalski is also concerned with the safety of the pedestrians with the increased traffic.

As no one further wished to speak, the Mayor declared the public hearing closed.

15. Resolution on the above.

Ald. Stroik moved, Ald. Moore seconded, to postpone until we hear from Portage County or the applicant regarding secondary/emergency access on River View Avenue.

Ald. Moore would like an additional full access point.

16. Ordinance Amendment - Building Inspector and Permits - Fees for General Construction and/or Building Alterations.

Ald. Trzebiatowski moved, Ald. Myers seconded, to approve the ordinance amending the Revised Municipal Code for the City of Stevens Point Sec. 30.02(4)(a).

Ald. Stroik asked how our fees compare to surrounding communities and how often they are reviewed.

Director Gardner said our fees are less and they are reviewed annually.

17. Consideration of minutes and actions taken at the Board of Public Works meeting of July 14, 2008.

Ald. Walther moved, Ald. Hanson seconded, to approve the minutes and affirm the actions taken at the
Board of Public Works meeting of July 14, 2008.

Roll Call: Ayes: Ald. Moore, Brooks, Stroik, Molski, Trzebiatowski, Slowinski, Heart, Wiza, Hanson, Walther, Myers.
Nays: None. Motion carried.

18. Ordinance Amendment - Collection of Garbage - How and when Collection is made and Charge for Collection.

Cris Harris, 2817 Jefferson Street, said it is not fair to limit the number of carts per parcel. She said it is unfair to the owners of three or four unit complexes. Ms. Harris urged the Council to offer owners of two, three and four unit buildings, the option of a second cart per address without an annual collection fee.

Ald. Myers moved, to amend the ordinance by removing the $50.00 per cart annual fee.

The motion failed due to a lack of a second.

Ald. Wiza questioned the definition of rubbish.

City Attorney Molepske did not have the definition for rubbish.

Ald. Wiza read the definition of garbage and rubbish which includes all inorganic refuse and matter such as tin cans, wire or metal of any kind, glass, china, crockery, paper, cloth, ashes, and similar things of that nature.

City Attorney Molepske said there is also a definition or requirement on recycling in the City Ordinance.

Ald. Wiza asked if the days for garbage and recycling collection will be the same.

Director Euclide replied, it will not be the same. He said recycling will be on the same day as garbage collection but it will be every other week.

Ald. Stroik said an owner of a duplex would be charged an annual fee of $50 for a fourth cart if they wanted two sets of carts for their tenants.

Director Euclide replied, yes.

Mayor Halverson explained the reason is to discourage the amount of carts. He said a particular property that produces large amounts of garbage should pay for it.

Ald. Myers said the problem with sharing carts is if there is a violation and no one will admit to doing it.

Ald. Trzebiatowski asked if apartments above commercial establishments will receive carts.

Director Euclide said they will get carts if they currently receive garbage and recycling collection.

Ald. Trzebiatowski said there is a concern where to store carts for the people who have garages that face an alley.

Director Euclide said the alleys are too narrow for the trucks. He said most people should have some manner to get the carts to the front of their homes.

Ald. Wiza asked if the old trucks will have the tippers on the back of them.

Director Euclide responded the old trucks will have back tippers in case of a break-down but the new trucks will only have them on the side.

Ald. Wiza asked if it was considered to have a special route for alley pick-ups.

Ald. Wiza moved, Ald. Moore seconded, to approve the ordinance amendment for garbage collection with the exception of recycling as stated in section 21.03(4)(a)1. a) through i).

Ald. Stroik moved, Ald. Wiza seconded, to amend section 7.06(3)(a) to allow one extra garbage cart and one extra recycling cart for a one-time fee of $50 for each cart up to a total of four carts.

Director Euclide stated there will be a maximum of four garbage carts and four recycling carts for any tax parcel.

Ald. Heart is uncomfortable with the amendments.

Ald. Hanson asked what happens if someone has more garbage than the maximum amount of carts will hold.

Director Euclide said they will have to go with a commercial garbage collector.

Ald. Molski moved, Ald. Moore seconded, approval the ordinance amendment creating Reserved Permit Spaces in Municipal Lot 11 in the 1300 block of Briggs Court.

Nays: None. Motion carried.

20. Ordinance Amendment - Traffic: Stop Signs on West Cornell Street eastbound and westbound at West River Drive.

Ald. Stroik moved, Ald. Moore seconded, approval the ordinance amendment.

21. 22. Consideration of minutes and actions taken at the Public Protection Committee meeting of July 14, 2008.

Ald. Stroik moved, Ald. Trzebiatowski seconded, approval of the
Public Protection Committee meeting of July 14, 2008, with the understanding that the Harvest Fest people paid their bill.

Roll Call: Ayes all.
Nays none. Motion carried.

Ald. Molski moved, Ald. Walther seconded, affirmed the actions taken at the
Finance Committee meeting of July 14, 2008 and the minutes are placed on file.

Nays: None. Motion carried.

24. Consideration of minutes and actions taken at the Personnel Committee meeting of July 14, 2008.

Ald. Hanson moved, Ald. Myers seconded, approval of the minutes and actions taken at the
Personnel Committee meeting of July 14, 2008.

Roll Call: Ayes: Ald. Moore, Brooks, Stroik, Molski, Trzebiatowski, Slowinski, Heart, Wiza, Hanson, Walther, Myers.
Nays: None. Motion carried.

25. Consideration of minutes and actions taken at the Board of Water & Sewage Commissioners meeting of July 14, 2008.

Ald. Slowinski moved, Ald. Trzebiatowski seconded, approval of the minutes and actions taken at the
Board of Water and Sewage Commissioners meeting of July 14, 2008.

Ald. Wiza asked what the percent is for the rate increase.

Director Halverson said the preliminary indication is about 8%.

Ald. Wiza asked if the funds from the percent increase will be used to build Well 11.

Director Halverson replied, no.

Ald. Wiza asked what the funds will be used for.

Director Halverson said it is for operating costs and expenditures. She said there will be another increase if Well 11 is built.

Ald. Wiza asked what the restrictive funds will be used for after Well 4 is paid.

Director Halverson said that is why no action was taken at the Board of Water and Sewage Commissioners meeting. She explained how the funds are used.

26. Consideration of minutes and actions taken at the Police and Fire Commission meetings of July 1, July 8, and July 15, 2008.

Ald. Stroik moved, Ald. Moore seconded, approval of the minutes and actions taken at the
Police and Fire Commission meetings of July 1, July 8, and July 15, 2008.

Dave Schliehs is available for any questions regarding the Public Safety Department and thanked the Council for supporting the creation of the Deputy Police Chief position.

Roll Call: Ayes all.
Nays none. Motion carried.

27. Mayoral Appointment: Appoint Joel Lemke to the Portage County Groundwater Citizens Advisory Committee.

Ald. Molski moved, Ald. Stroik seconded, approval of the appointment of Joel Lemke to the Portage County Groundwater Citizens Advisory Committee.

Roll Call: Ayes all.
Nays none. Motion carried.

28. Consideration of the statutory monthly financial report of the Comptroller-Treasurer for May 2008.

Ald. Stroik moved, Ald. Wiza seconded, to approve the statutory monthly financial report of the Comptroller-Treasurer for May 2008.

Nays none. Motion carried.
