3. Consideration of request to close West River Drive between Hwy. HH and Mapleridge Drive for approximately 45 minutes, beginning at 12:00 p.m. on March 1, 2008 and no parking on Henrietta Street between Francis Street and Whiting Avenue and no parking on Whiting Avenue between Henrietta Street and Water Street on March 1, 2008 until after 1:00 p.m. for the annual Point Bock Run.
4. Consideration of requests by the Deer Management Committee: 1. Grant Committee the authority to obtain quotes to use archery tackle and to employ deer cullers to cull deer using archery tackle through April 30, 2010, and 2. Grant Committee the authority to obtain quotes to use live trapping and to employ deer cullers to cull deer by using live trapping with the use of suitable firearms to dispatch trapped deer through April 30, 2010.
5. Consideration of Amendments to Chapter 12.14 - License and Permits - pertaining to fermented malt beverage and liquor sales.
6. Adjournment.

1. Recommendation on license list:

A. New Operator's (Bartenders) Licenses.

Ald. Trzebiatowski moved, Ald. Slowinski seconded, approval of the 33 new operator licenses. Ayes, all; nays, none. Motion carried.

B. Recommended Rejection of Operator (Bartender) License.

City Attorney Molepske noted that in his research of other surrounding communities only Wisconsin Rapids had written standards. In the others, applications were handled on an individual bases with the state statutes and police department's recommendation being the foundation for determining whether a license was granted.

Capt. Ruder stated that based on Mr. Bennett's record of having five OWIs that it was in everyone's best interest that the committee uphold the Department's recommendation of rejection.

Kathy King, Portage County Justice Planner, raised the fact that most problems involving individuals with an addiction arise between nine and eighteen months after being released. She feels that it takes at least five years of sobriety and being in a stable environment before the risk of recidivism is at a more acceptable level. She believes that at some point, with sustained sobriety and a sustained stable lifestyle, he could be considered. But she does not feel that it should happen in the next year to 18 months.

Chief Morris noted that licenses are general and if granted, he could take his license and work at any establishment including a bar. He urged the committee not to change the eligibility criteria for operator licenses.

Ald. Trzebiatowski moved, Ald. Slowinski seconded, to recommend rejection issuing an operator license to Mr. Bennett. Ayes: all; Nays: none; Motion carried.

C. Class "B" Beer License: K Bueno, LLC, Karl Halsey, Agent, 2149 Elk Street, Stevens Point, WI at K Bueno, 1137 Main Street, Stevens Point, WI (formerly Temptations of the Hearth).

Ald. Trzebiatowski, moved, Ald. Slowinski seconded, to approve a Class "B" Beer License for K Bueno, LLC, Karl Halsey, Agent, at K Bueno, 1137 Main Street, Stevens Point, WI. Ayes: all; Nays: none; Motion carried.

D. Transfer of "Class B" Beer and Liquor License: Randal T. Woyak, LLC, Randal T. Woyak, Agent, 3425 Church Street, Stevens Point, WI at Blue Top, 3425 Church Street, Stevens Point, WI from JJ Sondo's, LLC, 3406 Carter Avenue, Schofield, WI.

Ald. Stroik stated this item was pulled from the agenda.

Ald. Slowinski moved, Ald. Trzebiatowski seconded, to approve the "Class A" Liquor and Class "A" Beer License for Schierl Sales Corporation, Edward Storm, Agent, 1279 Robin Lane, Stevens Point, at the Store #58, 5601 Carrie Frost Lane. Ayes: all; Nays: none; Motion carried.

Ald. Slowinski moved, Ald. Stroik seconded, to approve the Change of Agent for Tim Schertz, Inc., 1366 Chippewa Trail, Mosinee, WI; Tim Schertz, 1366 Chippewa Trail, Mosinee, WI, agent and Pat Dunn, 2100 West River Drive, Stevens Point, WI, agent, at Nikki's, 835 Main Street. (Pat Dunn replacing Ashlie Jaskolski). Ayes, all; nays, none; motion carried.

2. Recommendation of the annual and monthly Inspection Report:

A. Construction Starts.
B. Violations.

Director Gardner noted that the City has one inspector for every 8,300 residents and noted that for the amount of work they do the City gets their money's worth. He also reviewed new construction over the past years and noted the volatility of it. In 2004, the City had $10 million in new construction and in 2007 the City had over $20 million.

Director Gardner also noted that not all attention is focused on new construction and pointed to the City's work with CAP Services in rehabilitation efforts. Working with CAP Services, they have put over $302,000 into renovation projects throughout the City.

Reid Rocheleau asked why the City does not hire more staff for the department.

Mayor Halverson noted that he would love to hire more people for the department but the City cannot afford it right now. He said that they have an aggressive and efficient staff.

Ald. Myer agreed with the Mayor about the good work that the department does for the City.

Ald. Stroik moved, Ald. Brooks seconded, to accept the annual and monthly Inspection Report and place them on file. Ayes, all; nays, none; motion carried.

3. Consideration of request to close West River Drive between Hwy. HH and Mapleridge Drive for approximately 45 minutes, beginning at 12:00 p.m. on March 1, 2008 and no parking on Henrietta Street between Francis Street and Whiting Avenue and no parking on Whiting Avenue between Henrietta Street and Water Street on March 1, 2008 until after 1:00 p.m. for the annual Point Bock Run.

Capt. Ruder stated this is an ongoing event and the Police Department has no problem with it.

Ald. Slowinski moved, Ald. Heart seconded, to approve the request to close West River Drive between Hwy. 5. Consideration of Amendments to Chapter 12.14 - License and Permits - pertaining to fermented malt beverage and liquor sales.

Capt. Ruder reviewed the proposed changes to the ordinance. He noted that the changes were mainly grammatical along with the change to the selling hours. The change in hours would bring the City into uniformity with the rest of the County.

Ald. Stroik asked about the change in checkout lanes.

Capt. Ruder said it would be changed to what the Department is currently practicing.

Ald. Stroik stated that he spoke with the Portage County A.O.D.A. and they had no objection to this change.

Ald. Trzebiatowski moved, Ald. Slowinski seconded, to approve the amendment with the change that the last sentence in section (4)(b) be struck.

Fritz Schierl suggested that in the future that the committee consider removing the words "solid unbroken" from section (4)(a).

Ald. Stroik said the committee would take that under advisement for future consideration.

Call for the Vote: Ayes: All; Nays: None; Motion carried.
